Today we are joined by renowned Temecula probate attorney, Steve Bliss. Mr. Bliss has years of experience navigating the complexities of probate law and helping families through difficult times.
Steve, thank you for joining us today. Can you shed some light on one of the key steps involved in estate planning?
It’s my pleasure to be here. One crucial step in the estate planning process is “Marshaling the Estate Assets.” This involves a thorough inventory and valuation of all assets belonging to the deceased person.
Can you elaborate on what that entails?
Certainly. We begin by identifying and listing all of the decedent’s assets, including real estate, bank accounts, investments, vehicles, personal property, and anything else of value. Accordingly, we then obtain appraisals for these assets to determine their current market value. This information is essential for filing the Inventory and Appraisal with the probate court (Form DE-160/161).
It’s a meticulous process that requires careful attention to detail. We often work closely with appraisers, accountants, and financial institutions to gather the necessary documentation.
Have you ever encountered any challenges during this stage?
I recall one case where the deceased individual had accumulated a significant collection of antiques and artwork. Locating and appraising these items proved to be quite complex.
We had to bring in specialized appraisers who could accurately assess the value of each piece. It took some time, but we were ultimately able to provide a comprehensive inventory that satisfied the court’s requirements.
In another instance, the decedent’s financial records were incomplete and disorganized. This made it challenging to identify all of their assets. We had to conduct extensive research and work closely with the family to piece together a complete picture.
How crucial is this step to the overall probate process?
Marshaling the estate assets is fundamental because it lays the groundwork for the subsequent steps in probate. The accurate valuation of assets is essential for determining the amount of estate taxes owed and for distributing the remaining assets to the heirs according to the will or intestate succession laws.
According to a 2021 study by the National Association of Estate Planners & Councils, over 60% of probate cases experience delays due to incomplete or inaccurate asset inventories.
What advice would you give to individuals who are planning their estates?
I encourage everyone to maintain organized and up-to-date financial records. This will make the probate process much smoother for your loved ones. Moreover, consider consulting with an experienced estate planning attorney who can guide you through the complexities of probate law and ensure that your wishes are carried out.
