Elder Law Advocate: A Conversation With Ted Cook

Hello everyone and welcome! Today we’re chatting with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to speak with me today.

What sparked your passion for elder law?

Well, it all started during my time volunteering at a local senior center. I saw firsthand the unique challenges that older adults face and realized how vulnerable they can be to exploitation and abuse. It was eye-opening, honestly. From there, I knew I wanted to dedicate my career to protecting seniors and ensuring they have the support they need.

Let’s dive into the process of elder protection. Can you outline the key steps involved?

Absolutely! Think of it like a roadmap designed to safeguard our elders:

  • A. Initial Client Engagement
  • B. Case Assessment
  • C. Protective Actions
  • D. Legal Proceedings
  • E. Long-Term Planning
  • F. Case Resolution & Follow-Up

Let’s focus on ‘Protective Actions’. Can you elaborate on that step and the various actions involved?

Protective Actions is often where things get really active – it’s about taking immediate steps to stop harm and protect the elder. We might file for restraining orders against abusive family members or caregivers, notify Adult Protective Services (APS) if there’s suspected neglect or abuse.

In some cases, we may need to seek guardianship or conservatorship if the individual lacks the capacity to make sound decisions about their own welfare. It’s crucial to act swiftly and decisively in these situations.

I remember one case where a caregiver was systematically draining an elderly woman’s bank accounts. It took some convincing to get the family on board with protective measures, but ultimately we were able to recover her stolen funds and place her in a safe environment.

Here are a few words from folks whose lives Ted has touched:

>“Ted was an absolute godsend when my mother became the victim of financial abuse. He navigated the legal system with expertise and compassion, helping us recover what was lost and ensure her safety.” – Maria Sanchez, Point Loma

>“Choosing Ted Cook to handle my estate planning was one of the best decisions I ever made. He explained everything clearly, made sure all my wishes were reflected in my documents, and gave me peace of mind knowing that my future is secure.”- John Davies, La Jolla

Ted, any final thoughts for our readers?
