Interview with Steve Bliss, San Diego Probate Attorney

Setting the Stage

Welcome back to San Diego News Now. Today we’re joined by Steve Bliss, a renowned probate attorney serving the San Diego community. Steve, thank you for taking the time to speak with us.

Probate: Demystifying the Process

Steve, for those unfamiliar with probate, could you briefly explain what it is and why it’s often necessary?

Probate is essentially a legal process that takes place after someone passes away. It involves validating their will (if one exists), identifying and inventorying their assets, paying off debts and taxes, and finally, distributing the remaining property to beneficiaries according to the deceased person’s wishes or state law. Ordinarily, probate is necessary when someone dies with assets solely in their name exceeding a certain threshold – in California, that’s currently $184,500.

A Closer Look: Handling Debts and Taxes

Let’s delve into one specific step of the probate process. Can you walk us through how debts and taxes are typically handled during probate?

Absolutely. Handling debts and taxes is a crucial stage in probate. The executor or administrator appointed by the court has the responsibility of identifying and paying valid creditor claims. This often involves reviewing financial records, contacting creditors, and ensuring that all legitimate debts are settled. Moreover, they must also file and pay any applicable federal and state taxes on behalf of the estate.

It’s important to remember that only debts incurred by the deceased individual are paid from the estate. Debts in someone else’s name aren’t the responsibility of the estate. For instance, if the deceased person had a joint credit card with their spouse, only their portion of the debt would be considered an estate liability.

A key aspect of this stage is accurate record-keeping and communication. The executor needs to maintain meticulous records of all transactions, including payments to creditors and tax filings. These records will ultimately be submitted to the court for approval as part of the final accounting.

  • Properly identifying valid debts
  • Gathering necessary documentation
  • Making timely payments
  • Filing accurate tax returns

The complexities of this process can be overwhelming, which is why seeking guidance from an experienced probate attorney like myself is essential. According to the California Bar Association, approximately 70% of probate cases involve some level of complexity requiring legal expertise.

Navigating Challenges: A Real-World Example

Steve, have you encountered any particular challenges during this debt and tax handling phase? Could you share a brief example?

Certainly. I recall a case involving an individual who passed away with significant outstanding medical bills. The family was unaware of the extent of these debts and initially struggled to locate all the necessary documentation. Through careful research and communication with healthcare providers, we were able to identify and consolidate the debts, ultimately negotiating a favorable settlement for the estate.

This experience highlighted the importance of thorough investigation and proactive communication in resolving debt-related issues during probate. Notwithstanding the complexity of the case, we were able to successfully navigate the challenges and ensure that the estate’s assets were distributed fairly to the beneficiaries.

Seeking Guidance: The Importance of Legal Expertise

Steve, what advice would you give to individuals who are facing probate for the first time?

“Probate can be a complex and emotionally challenging process. My advice is to seek guidance from an experienced probate attorney as early as possible. We can help navigate the legal requirements, minimize potential conflicts, and ensure that your loved one’s wishes are honored. Remember, you don’t have to go through this alone.”
