Moreno Valley Probate Attorney Steve Bliss Discusses Estate Planning

Good evening, Moreno Valley, and welcome back to our legal spotlight segment. Tonight, I’m joined by local probate attorney Steve Bliss of Moreno Valley Probate Law.

Steve, thanks for being here tonight. Let’s jump right in. For those unfamiliar with the term “probate,” what exactly is it?

You’re welcome! Probate is essentially the legal process of distributing a deceased person’s assets and settling any outstanding debts. It can be a complex and time-consuming procedure, especially if there isn’t a clear will in place.

And what role does estate planning play in avoiding probate?

Estate planning plays a crucial role in minimizing or even entirely bypassing the probate process. One of the most effective tools for achieving this is establishing a revocable living trust.

Can you elaborate on how a revocable living trust can help avoid probate?

Certainly! A revocable living trust allows you to transfer ownership of your assets into the trust while you’re still alive. You retain complete control over those assets as the trustee, meaning you can manage them and even make changes to the terms of the trust during your lifetime.

Consequently, when you pass away, the assets within the trust are already owned by the trust itself, not by you individually. This means they don’t have to go through probate court because the trust document outlines how the assets should be distributed according to your wishes.

Are there any drawbacks to using a revocable living trust?

While revocable living trusts are highly effective for avoiding probate, it’s important to remember they require careful setup and ongoing management. You’ll need to ensure all assets are properly titled in the name of the trust and that the trust document is updated as needed to reflect any changes in your circumstances or wishes.

Moreover, creating a revocable living trust typically involves legal fees, although these costs can often be offset by the long-term benefits of avoiding probate.

Have you encountered any specific challenges when working with clients on setting up revocable living trusts?

Over the years, I’ve helped countless families navigate the complexities of estate planning. One situation that comes to mind involved a couple who had accumulated significant assets but hadn’t yet taken steps to protect them through a trust.

Unfortunately, one of them became seriously ill unexpectedly. Without a trust in place, their children were faced with a lengthy and costly probate process during an already difficult time. I was able to guide them through the necessary legal steps, but it highlighted the importance of planning ahead and not waiting for a crisis situation.

Remember that according to the American Bar Association, over 70% of Americans do not have a will or estate plan.

What’s your advice for Moreno Valley residents who are considering estate planning?

My advice is simple: don’t delay. Estate planning isn’t just for wealthy individuals; it’s essential for everyone who wants to ensure their loved ones are taken care of and their wishes are honored after they’re gone.

Schedule a consultation with a qualified probate attorney like myself, and we can discuss your specific needs and develop a personalized plan that provides peace of mind for you and your family.
